Tinjauan Yuridis terhadap Penggunaan Artificial Intelligence dalam Proses Penegakan Hukum

Abstract
Perkembangan pesat kecerdasan buatan (Artificial Intelligence/AI) telah secara signifikan mentransformasi praktik penegakan hukum modern, termasuk pengawasan, identifikasi biometrik, pemolisian prediktif, dan investigasi forensik digital. Di Indonesia, penerapan AI dalam kepolisian mencerminkan upaya negara untuk meningkatkan efisiensi dan daya tanggap dalam menghadapi bentuk-bentuk kejahatan yang semakin kompleks. Namun, pemanfaatan AI juga menimbulkan persoalan hukum dan hak asasi manusia yang serius, khususnya terkait privasi, due process (proses hukum yang adil), kesetaraan di hadapan hukum, transparansi, serta akuntabilitas. Penelitian ini bertujuan menelaah kerangka hukum yang mengatur penggunaan kecerdasan buatan dalam penegakan hukum di Indonesia melalui analisis yuridis normatif. Metode penelitian menggunakan pendekatan peraturan perundang-undangan, konseptual, komparatif, dan hak asasi manusia, dengan bahan hukum kepustakaan sebagai sumber data utama. Hasil penelitian menunjukkan bahwa Indonesia belum memiliki kerangka hukum yang komprehensif dan eksplisit yang secara khusus mengatur penggunaan AI dalam penegakan hukum. Regulasi yang ada masih bersifat terfragmentasi dan sektoral, sehingga memunculkan celah pengaturan, ketidakpastian hukum, dan lemahnya mekanisme akuntabilitas. Studi ini menegaskan urgensi pembentukan tata kelola AI yang komprehensif, berbasis hak, dan akuntabel dalam penegakan hukum di Indonesia agar inovasi teknologi tetap selaras dengan prinsip negara hukum dan demokrasi konstitusional.
